1.Introduction:
This document outlines the terms and conditions for using the Cloud Based Electric Vehicle Enterprise Resource Planning (ERP) software in India (the 'B3 FINBOOK'). The Service is provided by B3 TECH STUDIO, a partnership firm incorporated under the laws of India. Hereafter 'B3 TECH STUDIO' will be referred as 'Company' and 'USER of B3 FINBOOK' will be referred as 'User' in this terms and conditions.
2. Use of Service:
The Service is intended for use by authorized users only. Users are responsible for maintaining the confidentiality of their account and password and for restricting access to their devices. Users agree to accept responsibility for all activities that occur under their account.
3. Data Ownership and Privacy:
The Company respects the privacy of its users and the protection of their data. All data entered into the Service will be owned by the user and the Company will not disclose any user data to any third party unless required by law. The Company may collect, use and share aggregated data in order to improve the Service and develop new features.
4. Intellectual Property:
The Service, including all software, technology, and content, is the property of the Company and its licensors and is protected by copyright and other intellectual property laws. Users are not allowed to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, transfer, or sell any information or software obtained from the Service.
5. Availability of Service:
The Company will make reasonable efforts to maintain the availability of the Service 24 hours a day, 7 days a week. However, the Service may be temporarily unavailable due to maintenance or technical issues. The Company will not be liable for any damages arising from any interruption of the Service.
6. Limitation of Liability:
The Company will not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Service, even if the Company has been advised of the possibility of such damages.
7. Modification of Terms:
The Company reserves the right to modify these terms and conditions at any time without prior notice. Users are responsible for regularly reviewing these terms and conditions.
8. Termination:
The Company may terminate or suspend the Service at any time on the end of their subscription period without prior notice. Upon termination, users will get only 30 days of windup period to export their data to tally format and the Company will have no obligation to maintain or provide any data after their windup period.
9. Governing Law:
These terms and conditions will be governed by and construed in accordance with the laws of India.
10. Entire Agreement:
These terms and conditions constitute the entire agreement between the Company and its users and supersede all prior understandings and agreements, whether written or oral, regarding the use of the Service.
